Terms and conditions
Article 1. Definitions:
1. SVU (SVU): the Sports Center of the Free University.
2. Member: the natural person (m/f/x), a legal person or party in whose name the membership is administered.
3. Agreement: the membership agreement between SVU and the Member with regard to Sports and access to the facilities of SVU.
Article 2. Applicability
These general terms and conditions apply to the conclusion and execution of the agreement, which is concluded between the SVU and the Member.
Article 3. Registration and Agreement
1. You can become a member of SVU in the following ways:
a. A fully completed digital registration via the website; or
b. by registering at the reception at one of the SVU locations.
2. The Agreement is concluded after registration with SVU and the amount due has been received by SVU.
3. The Member has the right to cancel the membership within 14 days after the day of registration without stating reasons, provided that the membership has not been used.
4. If the registration has taken place at one of the receptions of SVU, the Member has the right to revoke the Membership within 14 days. The revocation is free of charge provided the Member has not used the Membership within these 14 days.
5. Children under 16 are not allowed to enter the gym unless accompanied by an instructor in personal training.
6. Membership is strictly personal and cannot be transferred to another person.
7. The membership expires automatically.
Article 4. Payment terms
1. The membership agreement with SVU is entered into for the duration as indicated when registering. Each agreement has its own terms and conditions, as indicated on this website.
2. All membership fees are due in advance.
3. For entering into the membership, the Member pays the regular rate. SVU offers different subscription types. A student is required to prove eligibility for a student subscription and will promptly notify SVU of any changes affecting the granting of the discount.
4. Proof that the Member is eligible for a discount must be provided before the conclusion of the agreement.
5. The rates can be found on this website or can be requested at the reception of one of the SVU locations. During promotions, memberships can be offered for a different duration and/or price.
6. Payment of the membership must take place when entering into or renewing the membership and is only possible by means of cash or digital payment.
7. The Member can only opt for installment payment when opting for the all-in membership for a period of 12 months. SVU is entitled to enter into a membership by means of a. to refuse installments.
8. If the Member has opted for payment in installments, he must ensure that the monthly installment payment is made in the first week of the new month. The installment payment can be made online or at one of the sports center locations.
9. The installment amount is increased with administration costs (€50), which must be paid with the first installment payment. The Member owes a deposit upon payment of the first installment, which will be set off against the other installments.
10. In the event of late payment, the Member is in default without further notice of default. From the date on which the Member is in default, all installments due for the remainder of the membership become due and payable and must be paid by the Member to SVU within 30 days of the due date. If the Member remains in default, this claim will be handed over for collection. All costs involved in this are at the expense of the member. The Member may not use the services and facilities of SVU until such time as his due debt has been paid.
11. If SVU must proceed to collect its claim against the Member, the Member will furthermore owe the administration costs and (extrajudicial) collection costs in the amount of the graduated collection costs in accordance with the percentage referred to in the relevant collection laws and regulations, then 15% of the outstanding amount, with a minimum of €50. From the date on which an amount is due and payable, SVU can charge the Member 2% interest per month or the statutory interest, whichever is higher. The Member cannot use the services and facilities of SVU until the moment that his debt has been or will be paid in accordance with the agreements with the collection agency.
12. SVU is authorized to adjust the membership rates every year with the start of the new academic year. The adjustment of the rate takes effect when the Member takes out a new membership and does not affect the membership agreement that is current at that time.
Article 5. Duration, suspension, early termination and refund
1. In case of long-term illness, injury or pregnancy and studying or doing an internship abroad, the membership can be suspended with written permission from SVU. For suspension for reasons such as those in this article, a medical statement (attending doctor or physiotherapist) or confirmation from the Educational Institution must be submitted.
2. In case of relocation, the membership can be suspended or terminated with written permission from SVU, if the new place of residence is located outside a radius of at least 10 km outside SVU. The Member must enclose a copy of the Personal Records Database of the new municipalities.
3. An administration fee of € 20 will be charged for suspending or terminating a current membership.
4. The Member's payment obligation is suspended for the actual duration of the suspension. The termination date of the membership agreement is extended by the duration of the actual suspension.
5. Suspension must be submitted during the Agreement for which it is requested. Suspension requests after the end of the Agreement will not be honored.
6. SVU reserves the right to terminate the membership agreement with immediate effect in the event of a serious or repeated violation of the house rules or other proven unacceptable behaviour, at the direction of the management of SVU. The remaining contribution will not be refunded in these cases.
7. When buying products online, it is possible to pay online or use the outstanding balance. If a purchased product is cancelled, the remaining value is converted into balance. The remaining balance can be used to make online purchases, but cannot be refunded.
8. Students with a sports card from one of the 13 university sports centers (not applicable for HBO and MBO) may, when they intern in another university city, for example, use the facilities of the university sports center in that other city for a period of up to three months with that sports card. These students must be able to show an explanatory letter from a dean of students or the director of the sports center at their "home" institution. Each university athletic center admits students from all 13 universities to any part of the athletic program under the conditions in effect at the respective athletic center. Student must present a valid student ID card at the time of registration.
9. Early termination by SVU is (also) possible with immediate effect if:
-SVU suspects that participation in sports activities may adversely affect the Member's health. In this case, the remaining contribution will be refunded, possibly after deduction of costs incurred by SVU.
Article 6. Personal training
1. SVU offers the possibility of personal training, an activity that is not included in the membership.
2. Personal training is provided by the Sports Center staff. Third parties may only provide personal training with written permission from the management. Giving personal training without permission can lead to denial of the Sports Center.
Article 7. Personal data and privacy
1. SVU processes the personal data of the Member within the framework of the applicable laws and regulations, in particular the Personal Data Protection Act, in a manner and for the purposes as described below. SVU uses finger scan or QR code for this.
2. The privacy statement is available on request at the SVU reception or can be consulted via the SVU website.
3. The Member has a right of access, correction and opposition with regard to the processed personal data. SVU can charge costs up to the statutory maximum for an inspection and/or the implementation of corrections and/or for handling an objection. The Member can object to the processing of his personal data and send requests for inspection, correction and opposition to SVU, Uilenstede 100, 1183 AM in Amstelveen.
4. Camera surveillance is used within the Sports Center. The camera images are used for the following purposes, among other things: combating and preventing fraud, theft and irregularities within the Sports Centre. The camera images are stored for a period of 96 hours. The camera images can only be requested and consulted afterwards after permission from the management of SVU.
Article 8. Risk and liability
1. SVU is liable to the Member for damage as a result of an attributable failure to fulfill its obligations under the Agreement and for damage if and insofar as this is at the expense and risk of SVU by virtue of the law or this Agreement.
2. The Member is liable to SVU for damage as a result of an attributable failure to fulfill its obligations under the Agreement and for damage that is at the expense and risk of the Member under the law or this Agreement.
3. The use of sports materials, equipment, following a (training) program, lessons and/or activities of any kind from SVU is entirely at the Customer's own risk. The Member is not insured through SVU against the consequences of accidents. Closing a WA and
Article 9 Force majeure
1. SVU is not obliged to fulfill any obligation if it is prevented from doing so as a result of force majeure. Force majeure is understood in these General Terms and Conditions, but not exhaustively: war, revolution, riot, flood, pandemic/epidemic and any other external cause, which SVU could not reasonably have foreseen and/or prevented.
2. In the event of force majeure, the fulfillment of the relevant and the related obligation(s) will be wholly or partially suspended for the duration of such force majeure, without SVU being obliged to pay any compensation in this regard.
Article 10. House rules and rules of conduct
1. The Member is familiar with the house rules applied by SVU and must comply with them. The house rules are available at the various locations in the Sports Center and can be requested at the reception if desired.
2. SVU can at all times refuse or deny access to persons whose behavior gives rise to this.
3. SVU is entitled to change the house rules. Changed house rules immediately apply to everyone as of the date of announcement.
Article 11. Complaints
1. SVU has a complaints procedure and handles complaints in accordance with this procedure.
2. The Member submits complaints to SVU as soon as possible – but no later than within two weeks after the Member has discovered the defects – unless this cannot reasonably be expected of him. These complaints must be complete, clearly described and accompanied by any means of proof.
3. Failure to submit a complaint in time may result in the Member losing his rights in this regard.
4. SVU will answer the complaints submitted by the Member as soon as possible – but at the latest within two weeks – calculated from the date of receipt. If a complaint requires a foreseeable longer processing time, SVU will respond immediately with a notification of receipt and an indication of the period within which a more detailed answer can be expected.
Article 12. Interim changes
1. SVU may make interim changes to the facilities offered, class schedules, programs and opening hours. As far as possible, SVU will sufficiently announce the intended changes in advance.
2. SVU is entitled to change these General Terms and Conditions. The changes will be communicated to the Member 3 months before they come into effect via SVU website, e-mail, newsletter and/or social media. In the event of amendments to the General Terms and Conditions, the Member may terminate the Agreement prematurely within one month of the announcement of the amendments and the remaining membership fee will be refunded.
Article 13. Final provisions
1. By registering, the Member declares to accept these General Terms and Conditions and the house rules of SVU and to act accordingly.
2. These General Terms and Conditions and the house rules of SVU can be found on the SVU website and can be requested at the reception of one of the locations.
3. These General Terms and Conditions and all agreements entered into by or with SVU are exclusively governed by Dutch law. All disputes arising out of or in connection with this Agreement will be settled exclusively by the Court of Amsterdam.
